This course considers the uniquely American approach to the concept of the establishment of and freedom to exercise the right to be free in expression of religious liberty. Beginning with the founding of Plymouth Colony and the Maryland Colony as religious havens, we will trace the developments that lead to the creation of a Constitutional protection of freedom of religion. We will then consider the Establishment Clause, the Free Exercise Clause and Permissible Accommodations. Finally we will look at the present status of the Amendment in light of the Affordable Care Act and the Court’s ruling in Hobby Lobby and its progeny.
